Terms and Conditions for Submitting Health and Personal Information

 

Introduction

These Terms and Conditions ("Terms") govern your use of the online counselling referral form ("Form") provided by Futures In Mind CLG ("We," "Us," or "Our"). By using this Form, you agree to comply with and be bound by these Terms. Please read these Terms carefully before submitting your health and personal information. If you do not agree to these Terms, please do not use the Form.

 

GDPR Compliance

  1. Lawful Basis for Processing: We process your health and personal information on the lawful basis of your explicit consent for the purpose of referring you to a qualified counsellor or mental health professional.

  2. Data Controller: Talk To Tom CLG is the data controller responsible for processing your personal data. You may contact us at data@futuresinmind.ie for any data-related enquiries.

  3. Existing Service Users: If you're currently using Futures In Mind facilitated services or have used them in the past we may access your information. This ensures they can provide the best possible support during your crisis.

  4. Limits to Confidentiality: Before connecting to a therapist or volunteer, it's essential to be aware of specific situations where confidentiality might be limited. Here are the instances:

    • Self-Harm or Suicide Risk: If there's a clear risk that you might harm yourself or are considering suicide, and you've shared identifying information, we have a duty of care to share this information with the relevant authorities to ensure your safety.

    • Risk to Others: If there's evidence that you might harm someone else and you've disclosed your identity, the information will be relayed to the appropriate authorities.

    • Child Abuse Concerns: Under the Children First Policy Guidelines 2011 and the Children’s First Act 2015, if you provide information suggesting a child is at risk or has suffered abuse, and you've disclosed identifying details, we are mandated to report this to the relevant authorities.

 

Your safety and the safety of others are our top priorities. Please understand that these protocols are in place to provide the utmost care and protection.

 

Confidentiality and Data Minimisation

  1. Protection of Information: We are committed to protecting the privacy and confidentiality of your health and personal information. All data submitted through this Form will be treated with the utmost care and in compliance with the General Data Protection Regulation (GDPR) and applicable Irish data protection laws.

  2. Authorised Use: Your information will only be used for the purpose of referring you to a qualified counsellor or mental health professional. We will not share your information with third parties for marketing or other unrelated purposes without your explicit consent.

 

Information Submission and Consent

  1. Accuracy of Information: You are responsible for providing accurate and up-to-date information on the Form. Any inaccurate or incomplete information may affect the quality of your referral.

  2. Voluntary Submission: Submission of your health and personal information through this Form is entirely voluntary. You have the option to decline to provide certain information, but this may limit our ability to provide an appropriate referral.

  3. Consent: By submitting your information through this Form, you explicitly consent to the processing of your data for the purpose stated herein. You have the right to withdraw your consent at any time by contacting us at data@futuresinmind.ie.

 

Security and Data Retention

  1. Data Security: We employ robust security measures to protect your information from unauthorised access, disclosure, alteration, or destruction. However, we cannot guarantee the security of data transmitted over the internet.

  2. Data Retention: We will retain your submitted information for a period necessary to fulfil the referral request and any legal or regulatory requirements. After this period, your data will be securely deleted.

 

Data Subject Rights

  1. Access and Rectification: You have the right to access and rectify the information you provide on the Form. You may also request information about the processing of your data and exercise your rights under GDPR by contacting us at data@futuresinmind.ie.

 

Notification of Changes

  1. We reserve the right to amend these Terms to ensure ongoing compliance with data protection laws. Any updates will be posted on the Form, and your continued use of the Form will signify your acceptance of the revised Terms.

 

Governing Law

  1. These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the Irish courts.

Volunteer Protection

 

We understand that struggling with your mental health can be a challenging time. However, it can never be an excuse to treat others poorly. Talk To Tom operates a zero-tolerance policy concerning abusive or threatening behaviour towards our volunteers and contractors. 

 

We are here to keep our service users safe and to provide the best support we can, but we're also responsible for protecting our volunteers and counsellors from abuse, hostility and violence. 

 

The kinds of behaviours we consider to be unacceptable: 

 

  • Verbal abuse, aggression, and violence, including derogatory remarks, rudeness, inflammatory allegations, and threats of violence

  • Unreasonable demands.

  • Unreasonable persistence. 

  • Excessive letters, calls, emails and social media contact.

 

What action can Talk To Tom take?

  • End a call, visit or appointment 

  • Provide a single point of contact 

  • Limit contact to a single form, letter, or email 

  • In some instances, we may have no choice but to involve An Garda Siochana or pursue other legal action.
